Protest or evasion?

Great news today from the Legal realm of Canada, too bad the corporate media whores aren't reporting on it. Thankfully CBC must cover the Supreme Court,but they didn't do a good job this time. CBC Failed to go into detail on the final verdict. On the plus side it did make it into Main Stream Media for a day and I bet that it will disappear tomorrow.I went to the Supreme Court of Canada website and others to get more information on the case and found some legalese....

NATURE OF THE CASE

Taxation - Statutes - Assessment - Interpretation - Whether the Court of Appeal erred in law by removing the burden of proof of intent from the Crown in s. 239 of the Income Tax Act, R.S.C. 1985, c.1 (5th Supp.) - Whether the law on the level of mens rea in regard to section 239 under the Income Tax Act is sufficiently settled since R. v. Paveley (1976), 30 C.C.C. (2d) 483 (Sask. CA.) - Whether an honest, but mistaken, belief about invalidity should have a different effect than a mistaken belief about applicability of the Income Tax Act - Whether a belief of invalidity or applicability, if honestly held and proven so to the satisfaction of a jury, should have the same effect on state of mind no matter how arrived at - Whether the Court of Appeal confused reasonableness of the belief of the accused and availability of alternate legal remedies with the necessary intent, thereby setting-up a reasonableness test of a belief imposing a burden of proof upon the accused, which at criminal law can never be imposed in a complex statute like the Income Tax Act where the issue is knowing by making a false statement.

I'm a little rusty when it comes to translating legalese into common English, the basic idea is that some guy didn't want to give his hard earned money to a bunch of thieves in Ottawa and got charged with tax evasion then appeal it, which cause it to go in front the supreme court . In the appeal this man states that he doesn't believe the federal government has the constitutional right to collect income tax. Some people agree and other cases have been in the courts but never made it to the supreme court.

Jack Klundert of Windsor, Ont., has won a court case in which he was charged with refusing to pay about $350,000 in taxes.

Klundert, who says he doesn't believe the federal government has the constitutional right to collect income tax, was found not guilty of tax evasion.

Klundert accumulated a $350,000 tax bill between 1993 and 1998. When it came time to file his taxes he wrote "zero income" on his tax forms, when he in fact he earned about $1.5 million.

Klundert argued that disclosing his earnings to the government would be like "sitting down with thieves" and telling them where his valuables were.

Klundert said his actions did not constitute tax evasion, but were instead an honest protest.

His lawyer said the jury apparently agreed there was no criminal intent.



Hope it creates a precedent.Giving the people of Canada another way to protest against government abuses . Which could allow the citizens of Canada to have more of a say in where their money is spent. It would wise for people to become independent contractors and avoid the greedy hands of the government.

Harper... well let me just say, his election illustrates the degradation of human consciousness, and the ignorance of the canadian people.(I used a lower case C , because I think human beings are capable of seeking beyond national sovereignty's).
The recent american campaigns to foster fear and paranoia , to spread terror , played a role in the canadian people voting conservative , as well as gay marriage. The majority of voters are ill informed, and fanatical- focusing on one or two issues they don't really understand, and going off half-cocked.
Being the person I am, I spend a lot of time alone and in contemplation, and sometimes forget just how ignorant people tend to be.
It is sad to see masses, basing their lives, as they base their votes- on half truths and ignorance.
And this harper guy(no personal sovereignty either), purposed to use his "religion" as a way to sway the masses that were focused on terror and gay matrimony's.
Jesus admonished even his apostles to love all men as he would. Which means allowing people to make their own choices; If exercising ones free will does not hurt an innocent in the process, its all OK.
So, screw you"leaders" and wanna be leaders, who cant even run your own lives, when you learn not to embezzle, lie , commit fraud, beat your wives and molest your children, you might, just might get my vote.
Oh, and you religious leaders, popes priests shaman and rabbis etc- who study, dictate and teach- even though you remain ignorant to the truth.
More than one wise human or nonhuman has warned about the blind leading the blind. Your outdated and archaic doctrines, are based on partial truths and misconceptions at best. Leading others down this path is folly, and will lead only to suffering.
Teach what you know and face what you do not. You presume to be able to lead others to a higher realm, as you wallow in the darkness of fear and ignorance.
A true teacher seeks not to control, or to lead, he is content merely to provide an example.
So Preachers of Fallacy, just be aware that you traverse a slippery slope, and you are due to lose your footing.
Most of us are not much better than a bunch of damn dirty apes, and the rest are just stuck here in their ape-suits... shaking their heads in disgust.

It is easier to fight for one's principles than to live up to them














I'm a gamer, I play online games all the time, I've killed thousands of people online and have been killed thousands of times.Am I being conditioned to fight?
We live in a world full of violence and we support the use of violence in everyday life. Our Tv and movies promotes it, and thru violence we also create hate and revenge. This isn't healthy.... it could be our end if we keep on allowing these types of emotions to dominate our lives.
When I mean "our" I mean the "West"
...the "first world countries"
Now we are in an era of war, the so called "war on terror" where all participants lose since it's a war that cannot be won. The only winners are the double-dealing weapons makers which usually supply both sides in a fight. While the warring nations are fleeced losing both money and blood a few individuals benefit from the mayhem....

Sigh! ...what can you do?
I think I'll play some wolfenstein and leave you a good rant from a friend


on evolution: it does not make any sense to argue that people shouldn't be allowed to learn about the THEORY of evolution when their own cultural or religious beliefs may be otherwise. we have fossil and DNA evidence for evolution and what evidence do they have that their beliefs are more correct. TEACH BOTH! i think it is important to raise these arguments in school when kids are at a later age (i.e. gr11 or gr12). man... you can't argue that "you can't teach evolution out of respect for a culture"... because that is completely hypocritical. if you don't teach evolution, then you are disrespecting science and that has at least SOME legs to stand on (they evolved from flippers, but they're legs now).
on Harper: if he doesn't wisen up, they're gonna kick him out of office. he can't ignore parlimentary democracy AS WELL as choose his own reporters to talk to (when he actually does go in front of them!).
man oh man. we need a TRUE government. wasn't harper's big thing to be true and honest and not be all scandalous, and then AS SOON as he gets into office he goes and shuts out the reporters and goes over the heads of the opposition!!!!!!! and he isn't even letting the PEOPLE know what he is up to... he's makign all these decisions about IMPORTANT and DEBATEABLE issues, and no one knows about it, because he's shutting everyone out!...
THIS WORLD MAKES ME SO MAD!

Ancient Ways

Humanity needs to rediscover its decency - and not only that , but embrace and nourish it as well .
In days gone by many remembered to take the time for the spiritual aspect of man, but it seems that the world of today is materially consuming. We consume more and more material , thereby our very spirit is consumed.
Those of us with faith and insight are aware that this blasphemous conspiracy of politics , media , oil - is nearing its end. Nothing of this world will stand forever. The true children of the spirit are preparing for a new age.

Artificial Intelligence is no match for natural stupidity

Who owns the media? Who knows who owns the media? Will anyone tell us who owns the media? In this day and age our media is moving away from locally owned and operated to nationally and globally owned and operated outlets. As the media moves away from local ownership it is slowly being gobbled up by fewer and fewer individuals (most of the corporations are owned by only a few people)

90% of the media in Canada is owned by only Nine corporations. With the consolidation of the media, the stories and the “news” reported on are more biased and unhelpful to the local community. This allows for noteworthy news events to go under the radar screen (if, of course, they conflict with advertising interests). Corporate media is a controlled press. Not controlled by the government, but by stock holders interests. In a true democracy this type of media should not be allowed to flourish. In a true democracy, the media is completely uncontrolled and interested in protecting the local community.

In this day and age, we have a weapon. Called the blogsphere….. which allows anyone to be an editorial reporter or a journalist or pretend to be one of those types (like I’m doing). But there is no need for the corporation to win, when all you people out there can post away on the internet…. So please post. Please comment. Shout out and be heard. Just like wild coyotes barking at the moon.
